Dragon Fruit Smoothie respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Dragon Fruit Smoothie will respond expeditiously to claims of copyright infringement committed using the Dragon Fruit Smoothie service or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Dragon Fruit Smoothie's Designated Copyright Agent.

Upon receipt of a Notice as described below, Dragon Fruit Smoothie will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

  6. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  7. Delivery to Designated Agent: Send the completed DMCA Notice to Dragon Fruit Smoothie's Designated Copyright Agent via email at dmca@dragonfruitsmoothie.com or via mail at [Insert Physical Address if applicable].

Counter-Notification

If you believe that the material you posted on the Site was removed or disabled by mistake or misidentification, you may file a counter-notification with Dragon Fruit Smoothie by submitting a written notification to our Designated Copyright Agent that includes substantially the following elements:

  • Identification of the Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the URL(s) of the page(s) on Dragon Fruit Smoothie).
  • Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Contact Information: Your name, address, and telephone number.

  • Acceptance of Service of Process: A statement that you will accept service of process from the person who provided notification under DMCA subsection (c)(1)(C) or an agent of such person.
  • Physical or Electronic Signature: Your physical or electronic signature.
